France Implements Outdoor Smoking Ban in Parks, Beaches, and Near Schools

New French decree bans smoking on beaches, in parks, & at bus stops to protect children; vapes & cafe terraces currently exempt.

France Smoking Ban

A new decree banning smoking in many public outdoor spaces across France has been published in the Official Journal, with implementation beginning this Sunday. The ban, aimed primarily at protecting children from passive smoking, applies to beaches, public parks and gardens, and bus shelters.

The regulation is a key measure of the 2023-2027 National Tobacco Control Program, which seeks to create a "tobacco-free generation by 2032." Health Minister Catherine Vautrin stated, "Where there are children, tobacco must disappear," emphasizing that the freedom to smoke "ends where children's right to breathe clean air begins."

The decree does not currently apply to the outdoor terraces of cafés and restaurants, nor does it explicitly mention electronic cigarettes (vapes). It still requires a supplementary order from the Minister of Health to define the specific smoke-free perimeters around schools, libraries, and sports facilities. While non-compliance could eventually be punishable by a €135 fine, the ministry has indicated an initial period of "education."

This national law follows local initiatives by 1,600 municipalities that had already established smoke-free areas. Additionally, the new decree strengthens penalties for selling tobacco and vaping products to minors, now classifying it as a fifth-class offense punishable by a €200 fine.
